Create Jobs by Extending Bonus Depreciation and Eliminating the Placed in
Service Requirement
Background
In order to stimulate the economy, the Jobs and Growth Tax Relief Reconciliation
Act of 2003 included a powerful incentive for companies to buy new capital
equipment, including business aircraft. The incentive, known as "bonus
depreciation," changes the timing of the standard depreciation schedule to
give more depreciation in year one but less depreciation in all future years
(the total amount of depreciation remains unchanged). In order to qualify for
this accelerated depreciation schedule, the new capital equipment must be
purchased AND placed in service before January 1, 2005 .
Bonus Depreciation Works
Surveys of recent aircraft purchasers show that bonus depreciation has been
directly responsible for generating over $2 billion worth of new airplane orders
since its enactment last May.
These new orders have pulled the general aviation industry out of a downward
spiral and preserved or created more than 20,000 airplane manufacturing jobs in
the United States.
Cost Effective
Because bonus depreciation relates only to timing and does not change the total
amount that can ultimately be depreciated, its true cost to the federal
government is close to zero. In fact, when you consider the corporate taxes
airplane manufacturers must pay on their profits and the income taxes their
employees must pay on their wages, bonus depreciation is really a revenue raiser
for the federal government.
Extension Needed Now
Congress intended bonus depreciation to remain a powerful incentive for capital
purchases through 2004. But for products that take a long time to build, like
airplanes, the bonus depreciation incentive will effectively expire much sooner.
Bottom Line
Deductions for costs associated with ownership and operation of aircraft are limited according to the percentage of qualified business use of the aircraft. In general the aircraft must be used more than 50% for business purposes before any deductions are allowed, and then deductions (including depreciation) are prorated according to the actual percentage of business use.
The bonus first-year depreciation is 50%, bringing the total depreciation allowable in Year 1 up to as much as 60% of the acquisition cost of a new aircraft. For a California resident in the maximum Federal tax bracket this creates an instant cash tax deferral of approximately 26% (43% of 60%) of the total price of the aircraft - more than enough to handle a hefty down payment
